Terms of Service
These terms are an agreement between you and AG ("we", "us") about your use of Hu Accomponist and its server (together, the "Service"). By creating an account or using the Service you agree to them. If you do not agree, please do not use the Service. Our Privacy Policy explains how we handle your information.
Who may use the Service
You must be at least 13 years old, or older if the law where you live requires it. If you are under the age of majority where you live, you need a parent or guardian's permission. Give us accurate account details, keep your password to yourself, and tell us if you think someone else has used your account. You are responsible for what happens under your account.
Talk mode is for people 18 or older. It sends what you type or say to Google Gemini and ElevenLabs, and their terms require that the people using services built on them are adults. The app asks you to confirm that you are 18 or older before Talk mode works. The rest of the app does not need it.
What the Service does
The Service listens while you practise and gives you automated feedback on your playing, turns your humming into a song you can edit by typing or speaking, and offers a library of sheet music and music quizzes.
Your content
Your recordings, hums, songs and requests are "Your Content". You keep ownership of Your Content. You give us a limited, non-exclusive permission to process, store and send it as needed to run the Service for you, including to the service providers named in our Privacy Policy. You are responsible for having the right to use the tunes and recordings you submit.
We provide the songs the Service makes from your hum for you to use, and we do not claim ownership of them. Because they are generated automatically, we cannot promise that they are free of similarity to other music.
Sheet music and quiz content
The score library is a selection from PDMX, a public-domain MusicXML dataset ("PDMX: A Large-Scale Public Domain MusicXML Dataset for Symbolic Music Processing", Long et al., 2024), which is licensed under CC BY 4.0. We made changes: we kept only a small part of it.
The dataset's public-domain labels are chosen by the people who uploaded the scores, and are not checked by its authors. So we screen the library ourselves: we offer only scores that the dataset does not flag for a licence conflict and whose composer lived long enough ago that the music is in the public domain. A screen like this can still make mistakes. Scores belong to their respective owners and are provided for personal practice. We do not guarantee that any score is accurate, complete or error-free. If you believe a score should not be in the library, write to us and we will remove it promptly.
Automated feedback and artificial intelligence
Feedback on your playing is produced automatically by software and can be wrong. It is guidance for practice and not professional music teaching, and we are not responsible for decisions you make because of it. Talk mode uses artificial intelligence services run by other companies (see the Privacy Policy). Their answers can be inaccurate or unsuitable, and you should not put sensitive personal information into your requests.
Acceptable use
You agree not to:
- break the law, or use the Service to harass, threaten or harm anyone;
- submit content you have no right to use, or that is unlawful or abusive;
- try to get around the Service's limits or security, including its sign-in, key checks and rate limits;
- overload the Service, scrape it, or reverse-engineer it except where the law lets you;
- use the Service to build a competing product, or to spend the AI services' capacity on something other than editing your own song.
Our rights
The app, its software, design and name belong to us or our licensors. We give you a limited, revocable, non-exclusive, non-transferable licence to use the app on Apple devices you own or control, for your personal use. The app includes open-source software under its own licences, which you can see in the app under Settings, then Open-source licenses.
Ending your use
You can stop at any time, and you can delete your account in the app under Settings, then Delete account. We may suspend or end your access if you break these terms or if we need to protect the Service or other people. Parts of these terms that by their nature should continue (such as the disclaimers, the limits on liability and the governing law) continue after your access ends.
Disclaimers
The Service is provided “as is” and “as available”. To the fullest extent the law allows, we do not promise that it will be uninterrupted, error-free or suited to your particular purpose.
Limit of liability
To the fullest extent the law allows, we are not liable for indirect, incidental or consequential losses, or for lost data, profits or opportunities. Our total liability to you for anything connected with the Service is limited to the amount you paid us for it in the previous 12 months, or CAD $50 if you paid nothing. Some places do not allow these limits, and nothing in these terms limits rights you have under consumer protection law that cannot be waived.
Governing law
These terms are governed by the laws of the province or territory of Canada where AG is based and the federal laws of Canada that apply there. The courts of that province or territory can hear disputes, except that you may also bring a claim in the courts where you live if your local consumer law gives you that right.
Changes
We may update the Service or these terms. We will change the date at the top, and tell you in the app or by email if a change is important. If you keep using the Service after a change, you accept the updated terms. If you do not accept them, you can delete your account.
Additional terms for the Apple App Store
If you got the app from the Apple App Store, these also apply:
- Between you and us only. These terms are between you and AG, not Apple Inc. ("Apple"). Apple is not a party to these terms. We, not Apple, are responsible for the app and its content.
- Licence. Your licence is limited to use on Apple-branded products you own or control, as the Usage Rules in the Apple Media Services Terms allow.
- Maintenance and support. We alone are responsible for maintenance and support of the app (see our Support page). Apple has no obligation to provide any.
- Warranty. If the app fails to meet a legal warranty, you may tell Apple, and Apple will refund the purchase price if there is one. To the extent the law allows, Apple has no other warranty obligation for the app.
- Claims. We, not Apple, are responsible for claims about the app, such as product liability, legal or regulatory compliance, and consumer-protection or privacy claims.
- Intellectual property. If a third party claims that the app infringes its rights, we, not Apple, are responsible for investigating, defending and settling the claim.
- Legal compliance. You confirm that you are not located in a country under a U.S. government embargo or designated as a terrorist-supporting country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Third-party terms. You must follow any third-party terms that apply when you use the app, such as your mobile data agreement.
- Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. Once you accept them, Apple can enforce them against you as a third-party beneficiary.
